Arbitrators can often make a decision solely on the basis of documents (which can be as simple as letters) provided by both parties. Arbitration in this way can avoid a personal interview that could be time-taking and uncomfortable. However, if one of us decides that a personal interview is necessary, it is possible to schedule one. If everyone agrees, the hearing can even take place by phone. If you are an individual (not a company), it is up to you to be represented by an arbitration lawyer. For claims of $10,000 or less, you can choose either the AAA`s Consumer Arbitration Rules for Consumer Disputes, or the BBB`s Binding Arbitration Rules, or an individual action in small claims court.
